ICAI CA Exam 2021: SC Asks Institute To Consider Modifying Withdrawal Schedule | Competitive exams



The Supreme Court on Tuesday asked the Institute of Chartered Accountants of India (ICAI) to consider changing the withdrawal program after ruling that the program formulated by the institute did not take into account applicants’ inability who have recovered from Covid-19.

In a note provided on Monday, the ICAI said that for its exams starting July 5, there will be an opt-out program for students who are able to produce a positive RT-PCR report showing that they or any member of the their families are affected by COVID-19 as of June 21 or later.

A bench of three judges led by Judge AM Khanwilkar noted that the RT-PCR alone cannot determine the incapacity of candidates. Almost 3.74 lakh students will sit for the July exam cycle. The bench said that sometimes the aftermath of COVID-19 is so “horrendous” that those affected are unable to recover for the next two to three months. The Court asked the ICAI to take this aspect into account as well by having a competent authority or person authorize on behalf of the ICAI whether a candidate should be allowed to withdraw from the present examinations.

In addition, the bench asked the ICAI if students infected in the middle of exams would be allowed to give the remaining papers during the November exam cycle. The Court also noted a host of other suggestions put forward by the applicants, such as changing the examination center, ensuring the exclusivity of examination rooms, testing facilities for supervisors and the organization of examinations. means of transport to the centers. Senior lawyer Ramji Srinivasan appearing for the ICAI said the institute will respond to all points noted by the court.

The judiciary asked the ICAI to file its response during the day and took the case under advisement on Wednesday.

The petitions were filed by Satya Narain Perumal, Anubha Shrivastava Sahai and third by a group of CA aspirants demanding moderation in the published standard operating procedure for exams, among other reliefs. The petitions also called for postponement of exams, extra chance and opt-out options for students amid the pandemic.

CA exams will be held July 5-20, 2021 across the country at various centers. The Institute issued the admission card and also issued guidelines for exams across the country.
